By using SimpleDMARC, you agree to these Terms of Service. Please read them carefully. If you do not agree, do not use our platform.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and SimpleDMARC ("we," "our," or "us") governing your access to and use of the SimpleDMARC platform, including our website, APIs, and related services (collectively, the "Service"). By creating an account or otherwise using the Service, you accept these Terms.
2. Eligibility
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the business you represent. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately at security@simpledmarc.com of any unauthorized use of your account.
4. Permitted Use
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Violate any applicable law or regulation
- Use the Service to monitor domains you do not own or have authorization to manage
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Reverse engineer, decompile, or disassemble any component of the Service
- Use automated means to scrape or extract data from the Service without our written permission
5. Subscription and Payment
Access to certain features requires a paid subscription. All fees are non-refundable except as expressly required by law or as stated in our refund policy. Subscriptions auto-renew unless cancelled before the renewal date. We reserve the right to change pricing with 30 days' written notice.
6. Intellectual Property
The Service, including all software, content, branding, and documentation, is owned by SimpleDMARC and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
8. Limitation of Liability
To the maximum extent permitted by law, SimpleDMARC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
9. Termination
We may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting support.
10. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be subject to binding arbitration.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through a prominent notice on our website at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the new Terms.
